Terms and Conditions

These terms apply when you purchase website design and build services from Pepped (Olivia Hank Pty Limited, ABN 74 610 772 999). Please read them before you buy. By purchasing, you agree to them.
1. Who we are
Pepped is an Australian business providing website design and build services.

In these terms, "we", "us", and "our" means Pepped. "You" and "your" means the person or business purchasing our services.
2. What you're buying
The Starter Site is a five-page website built on one of our three existing designs, adapted to your business. It includes everything listed on our website at the time you purchase.
Add-ons are additional services purchased separately, at the prices listed on our website or quoted to you directly.
Ongoing services are the care plan and shop maintenance plan, charged monthly.
The full description of what's included is on our website. If something isn't listed there, it isn't included.
3. Prices and payment
All prices are in Australian dollars and include GST.
The Starter Site is payable in full at the time of purchase. Work does not begin until payment is received.
Add-ons are payable before that work begins.
Monthly services are charged in advance and continue until cancelled.
Payments are processed by Stripe. We do not store your card details.
We may change our prices at any time. A price change won't affect a project you've already paid for.
4. What isn't included
Two costs are yours and are paid directly to the provider, not to us:
Your domain name. You purchase it and it's registered in your name. We'll help you choose and connect it.
Your hosting. You pay the hosting provider directly. We'll set it up with you.
Also not included unless purchased as an add-on: copywriting, logo and brand design, photography, professional stock image licences beyond standard free-use images, email hosting, SEO campaigns, migration of an existing website, and configuration of third-party systems beyond linking to your booking page.
5. What we need from you
Your brief. After purchase we'll send you a Brand Brief. We need it completed before we start.
Your content. You supply all text, images, and business information. You're responsible for making sure it's accurate and that you have the right to use it.
Your responsiveness. Projects move at the speed of the slower party. We'll be prompt, and we ask the same.
6. Timing
Your first draft will be delivered within 10 business days of us receiving your completed Brand Brief and all required content.
If your brief arrives incomplete, the 10 business day period starts when the missing pieces arrive.
If we don't receive your completed brief within 90 days of purchase, your project will be placed on hold. We'll email you first. Restarting a project that's been on hold for more than six months may attract a fee of $150 to cover rescheduling.
We'll always tell you if something on our end is going to cause a delay.
7. Revisions
Your build includes three rounds of revisions before launch.
A round is one consolidated list of changes from you, actioned by us in one go. Sending feedback piece by piece across several emails will use up your rounds faster, so please gather it into one list each time.
Revisions must be used within 30 days of you receiving your first draft. Unused rounds expire.
Revisions cover adjustments to the site as built: content changes, image swaps, layout tweaks within the design, colour adjustments. They don't cover switching to a different template, adding pages, or adding features not in the original scope. Those are quoted separately.
If your feedback would substantially change the agreed scope, we'll tell you and quote it before doing the work.
8. Launch
Once you've approved the site, we'll connect your domain and make it live. Approval means you're satisfied the site is complete and correct. Please check it properly, including your contact details, pricing, and any claims you've made.
9. Changes after launch
Changes after launch are charged at $100 per hour incl. GST, billed in 30-minute increments with a 30-minute minimum. We'll give you an estimate before starting any work over one hour.
10. Ongoing plans
Care plan, $30 per month incl. GST. Covers hosting management, regular backups, keeping the site updated, and up to 20 minutes of small text edits each month. Unused time doesn't roll over.
Shop maintenance, $50 per month incl. GST. Required for sites with a shop. Covers the same as the care plan plus maintenance of the shop functionality.
Both are charged monthly in advance. You can cancel with 30 days' notice by emailing hello@pepped.co. We may cancel with 30 days' notice too.
If you cancel shop maintenance, we're no longer responsible for the shop's ongoing function, security, or updates.
11. Who owns what
You own your content. Everything you supply remains yours.
You own your website once it's paid for in full. The finished site, and your domain, are yours to keep, move, or hand to another designer at any time.
We own our designs. The three underlying template designs, and any design systems, components, or code we've built for reuse, remain ours. You're buying a website built on one of them, not the template itself. You can't resell, license, or redistribute the design as a template.
We may show your site in our portfolio and on social media, including a link to it, unless you ask us not to in writing.
12. Your content and your claims
You're responsible for everything you tell us to publish.
You confirm that:
- You own or have permission to use all text, images, logos, and testimonials you supply
- Your content is accurate and not misleading
- Your content doesn't infringe anyone else's rights
- Any testimonials are real and used with permission
Health practitioners, this part matters.
Advertising by health practitioners in Australia is regulated, including by the Therapeutic Goods Administration, the Australian Competition and Consumer Commission, and in some cases your professional association or AHPRA. The rules cover claims about treatments and outcomes, the use of testimonials, and how services are described.
You are responsible for making sure your website content complies with the rules that apply to you. We'll flag anything obvious we notice, but we're not qualified to assess your compliance and we don't take responsibility for it. Please review your content, and get advice if you're unsure, before we launch.
You agree to indemnify us against any claim arising from content you supplied or approved.
13. Third-party services
Your site relies on services we don't control, including your domain registrar, your hosting provider, your booking system, Stripe, and the platform the site is built on.
We're not responsible for their performance, availability, pricing changes, or discontinuation. If one of them changes in a way that affects your site, fixing it is chargeable work.
14. Cancellations and refunds
Before your first draft. You can cancel and we'll refund what you've paid, less a fair amount for work already done. If we haven't started, you get a full refund.
After your first draft. Because the work has been done specifically for you, refunds aren't available at this point. If something isn't right, tell us and we'll use your revision rounds to fix it.
Nothing in these terms limits your rights under the Australian Consumer Law.
You're entitled to a repair, replacement, or refund for a major failure, and to compensation for reasonably foreseeable loss or damage. These rights can't be excluded, and nothing here is intended to.
15. Our liability
We'll do our work with due care and skill.
To the extent permitted by law, and other than for the consumer guarantees described above, our total liability to you is limited to the amount you've paid us for the service in question.
We're not liable for indirect or consequential loss, including lost profits, lost business, or loss of data.
We don't guarantee any particular result from having a website, including traffic, enquiries, bookings, or search engine rankings.
16. Confidentiality
We'll keep your business information confidential and won't share it except as needed to deliver our services, or where required by law.
Please don't send us information about your patients or clients, including health information or case notes. If you do, we'll ask you to remove it and we won't retain it.
17. Privacy
We handle personal information in line with our Privacy Policy, available at the bottom of the home page.
18. Ending the arrangement
We may stop work and end the arrangement if:
- Payment isn't made when due
- You don't respond for more than 90 days
- You ask us to publish content we believe is unlawful, misleading, or harmful
- The working relationship becomes unreasonable
If we end things under this clause, we'll refund any amount that relates to work not yet done.
19. Changes to these terms
We may update these terms. The version that applies to you is the one published when you purchased.
20. Governing law
These terms are governed by the laws of New South Wales, Australia.
